Abstract

Regulatory gaps in the legislation, both at the country level and the difference categorial-conceptual apparatus that is used in different countries allows fi nancial institutions to use the regulatory and tax arbitrage In the article the basic concepts of financial institutions, clarifi ed the content and significance of categorial-conceptual apparatus – “financial institution”, “financial intermediary”, “financial assets”, “financial service” to their legal unification. This will bring clarity to the  understanding of these subjects and objects of financial marketand eliminate the possibility of abuse by financial institutions .
